HTIA Statement on Introduction of PERA and PREVAIL

MAY 1, 2025, WASHINGTON—Dave Jones, executive director of the High Tech Inventors Alliance (HTIA), issued the statement below following the introduction of the Patent Eligibility Restoration Act (PERA) and the Promoting and Respecting Economically Vital American Innovation Leadership Act (PREVAIL). PERA is legislation that would roll back centuries of patent eligibility law, flooding the market with weak patents, a gift to patent trolls. PREVAIL is legislation that would dismantle the Patent Trial and Appeal Board (PTAB), an essential body that expertly and efficiently addresses invalid patents. These bills would be a win for patent trolls, while leaving American businesses vulnerable.      

“PERA and PREVAIL are misguided bills that would harm U.S. innovation and benefit foreign patent trolls at the expense of American competitiveness. These bills would enable those who abuse our litigation system and would subject American companies to baseless lawsuits without tools to fight back. By gutting patent eligibility standards and crippling the PTAB, they reward exploitation over innovation, strangling R&D and wiping out high paying jobs. Congress must reject this massive giveaway to foreign entities and protect a patent system that fuels American technological progress.”
